1. Server log files

We automatically collect and store information in so-called server log files which your browser automatically transfers to us. These include:


/ Browser type and browser version
/ Your operating system
/ Referer URL
/ Hostname of the accessing computer
/ Time of the server request
/ IP address


These data are not combined with other data sources.


The data processing is based on Art. 6 para. 1 lit. b GDPR, which allows the processing of data for the performance of a contract or to take steps prior to entering into a contract.


The system has to store the IP address temporarily in order to transmit the website to the computer of the user. This requires storing the IP address of the user until the end of the session.


The log files are stored in order to ensure the correct functioning of the website. We also use these data to optimise our website and to ensure the security of our IT systems. These data are not evaluated for marketing purposes.


The data are erased as soon as they are no longer required for the purpose of their collection. In the event that the data are collected to provide the website, the data are erased once the relevant session ends.


Data saved in log files are erased after a maximum period of seven days. There is no further storage and the data are not combined with other data.


The collection of data for providing the website and the storage of data in log files is an unavoidable requirement for the operation of the website; the user is therefore not entitled to object to such data collection and storage.

 

2. General data collection

Our server automatically collects data of visitors to the website, as set out above under “server log files”.

 

We will only collect personal data if you send us an email to establish contact, to ask a question or to submit your job application. We will store data you enter (such as your name, email and phone number) and use it for the purpose of communicating with you individually. If you submit a job application, we will store your personal data only as long as is required for the application process. Please note that the data transfer is not encrypted and that you should therefore not submit confidential data via unencrypted email. We will store your email address until you demand its erasure or until a request by you has been completed. We will then erase your email address without delay. This is based on your consent (Art. 6 para. 1 lit. a GDPR).

 

Otherwise, we will use the data provided by you to carry out the contract. After the contract has been carried out, your data will be blocked from any further use and erased after the retention periods prescribed under tax and commercial law expire, unless you have expressly consented to the further use of your data or if we have reserved the right for a further (legally permissible) use of the data, about which we inform you below. This data processing is based on Art. 6 para. 1 lit. b GDPR, which allows the processing of data for the performance of a contract or to take steps prior to entering into a contract.

 

Transfer of your personal data
Your data will be disclosed to third parties only in accordance with the data protection rules. Your data will not be disclosed for advertising purposes or other purposes.
Anonymized data is provided to municipalities for statistical purposes exclusively in accordance with the law.


In order to complete the contract, we will transfer your data to the shipping company tasked with the delivery, to the extent that this is required in order to deliver ordered goods. In order to settle payments, we will transfer the necessary payment data to the financial institution tasked with processing the payment and (if applicable) payment services provider commissioned by us or to the payment service you select during the ordering process.


In the event of requests which do not fall within the scope of our sales market, or if we are unable to deliver the requested product, we will forward the request to sister companies within the Binder Group. All our sister companies are based in the EU and are therefore also subject to the General Data Protection Regulation (GDPR). Your email address will be stored there until your request has been completed and erased thereafter, unless statutory retention obligations impose different requirements. Should a sister company be able to fulfil the request, it will notify you and it will be responsible for assisting you from then on. In this case, we will erase your email address without delay, unless statutory retention obligations impose different requirements.


Should we receive your email address in connection with the sale of goods or services, we reserve the right to email to you offers from our product range which are similar to those you have already purchased, unless you object to such communication. You may always object to such use of your email address via the contact option described above or via the appropriate link in the marketing email, without incurring any costs other than the transmission costs in accordance with the basic tariffs.

USE OF DATA FOR POSTAL ADVERTISING AND YOUR RIGHT TO OBJECT

3. Use of cookies

We use cookies to ensure the efficient and user-friendly design of our website. Cookies are small text files which are stored on your computer and which are saved by your browser. Most of the cookies we use are so-called session cookies which are erased from your hard drive automatically once the browser session is concluded. So-called persistent cookies on the other hand will remain on your computer and enable us to recognise your computer on your next visit.


You have the option of preventing any storage of cookies on your computer by selecting the appropriate browser configuration. You will still be able to make full use of this website for the most part.


Cookies required to carry out electronic communication or to provide certain functions you request are stored in accordance with Art. 6 para. 1 lit. f GDPR. We have a legitimate interest in storing cookies to enable us to ensure that we are able to optimise the provision of our services and to eliminate any technical malfunctions. Insofar as other cookies (such as cookies for analysing your surfing behaviour) are stored, these will be discussed separately elsewhere in this data protection statement.

 

4. Contact form

Only by transferring your information and after clicking the “Send” button of the contact form do you consent to us saving the information you provided in the contact form, in particular your personal data, in order to pass it on as requested by you. Once these data are no longer required for the intended purpose, we will erase these data.


These data will be forwarded only to the recipient indicated in the relevant contact form; the recipient is also contractually obligated to observe the data protection rules. No personal data will be disclosed to third parties.

An email to us will suffice, there are no formal requirements. The withdrawal of consent does not affect the legitimacy of the data processing which occurred prior to the withdrawal.

 

5. Registration for a delivery information request under liefinfo.klenk.de

You can register on liefinfo.klenk.de for access to delivery information. This requires you to enter your customer number. We will use the data you enter in order to provide the access to the delivery information. To this end, we will create a passport for your customer registration which you can use in the future in order to log into our delivery information system.


The data you enter for the registration are processed on the basis of your consent (Art. 6 para. 1 lit. a GDPR). You can withdraw any given consent at any time. An email to us will suffice, there are no formal requirements. The withdrawal of consent does not affect the legitimacy of the data processing which occurred prior to the withdrawal.

 

6. Your rights of access, rectification, blocking, erasure and transfer relating to your data

You are entitled to demand information about the origin, recipient and purpose of your stored personal data at any time and free of charge. You are also entitled to demand the rectification, blocking, transfer or erasure of these data. Feel free to contact us at any time under the address indicated above if you have such requests or if you have other questions relating to the topic of data protection. You are also entitled to lodge a complaint with the competent supervisory authority.

 

7. Data security

Your personal data are transferred via the Internet in an encrypted form (SSL v3). We use technical and organisational measures to secure our website and other systems against loss, destruction, access, modification or distribution of your data by unauthorised persons. Access to your customer account requires entering your personal password. You should always keep your login information confidential and close the browser window after you complete your communication with us, in particular if you use your computer together with others.

 

8. The right to lodge a complaint with the competent supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you believe that the processing of personal data relating to you infringes the GDPR.


The supervisory authority with which the complaint has been lodged will inform the complainant on the progress and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Article 78 GDPR.

 

9. Access, blocking, erasure

Under the applicable legal provisions, you have the right to demand, at any time, access to your stored personal data (free of charge) and information about their origin and recipient and the purpose of the data processing; you also have the right (where appropriate) to demand rectification, blocking or erasure of these data. 10. General withdrawal of the consent to data processing and use

We will then completely erase your data without delay, unless statutory storage/retention obligations impose different requirements. In this case, the data will be blocked, unless there is a legal basis allowing data processing.

This data protection statement is current as of May 2018  and currently valid.


It may become necessary to change this data protection statement as we improve our website and web-based services, or due to changing requirements imposed by the law or official authorities.
